1. About us

This website is operated by ORCA DIGITAL PTY LTD (ACN 612 263 144, ABN 47 612 263 144), an Australian proprietary company registered in New South Wales, with its principal place of business at 101–105 Coral Sea Drive, Mossman QLD 4873, Australia. In these Terms, "we", "us", "our" and "Orca Digital" refer to ORCA DIGITAL PTY LTD.

By accessing orcadigital.shop or placing an order, you agree to these Terms of Service. If you do not agree, please do not use this website.

2. What we sell

We sell digital software licences and activation keys. Our products are delivered electronically. No physical goods are shipped at any time.

Each product listing states what you receive, the licence duration, and the platforms supported. Please read the listing carefully before purchasing.

3. Independent reseller — no affiliation

Orca Digital is an independent reseller. We are not the publisher or developer of the software we sell, and we are not affiliated with, endorsed by, or sponsored by any software publisher, unless a listing expressly states otherwise.

All third-party trademarks, product names and logos are the property of their respective owners and are used solely for identification and compatibility purposes.

Your use of any software you activate with a key purchased from us is governed by that publisher's own licence agreement, not by these Terms. You are responsible for reviewing and complying with it.

4. Eligibility and account requirements

Some licences require you to create or sign in to an account with the software publisher in order to redeem them. Some licences are restricted to particular countries or regions. Where restrictions apply, they are stated on the product page.

Before purchasing, it is your responsibility to confirm that:

  • your device and operating system meet the software's system requirements;
  • your region is supported; and
  • you are able to create any publisher account the licence requires.

You must be at least 18 years old, or have the consent of a parent or guardian, to purchase from this website.

5. Pricing, currency and taxes

All prices are displayed in the currency shown at checkout. Prices are subject to change without notice, but changes do not affect orders already placed.

Where applicable, Australian GST or other taxes are applied and shown at checkout. Customers outside Australia may be responsible for any taxes, duties or charges imposed in their own jurisdiction.

6. Orders and acceptance

Your order is an offer to purchase. We accept your order when we deliver your licence key. We may decline or cancel an order — and will refund you in full — where:

  • the product is unavailable or was listed in error, including at an incorrect price;
  • we are unable to verify your payment; or
  • we reasonably suspect fraud or a breach of these Terms.

7. Delivery

Licence keys are delivered by email immediately after payment is confirmed, and are also shown on your order confirmation page. Full details are in our Delivery Policy.

8. Refunds

Your rights to a refund, replacement or repair are set out in our Refund & Returns Policy, which forms part of these Terms. Nothing in these Terms limits your rights under the Australian Consumer Law.

9. Prohibited conduct

You must not:

  • resell, redistribute, or publish keys purchased from us without our written consent;
  • attempt to obtain refunds for keys you have already activated, except as permitted by law;
  • use this website to infringe any third party's intellectual property rights;
  • interfere with the security or operation of the website, or attempt to gain unauthorised access to it; or
  • use automated systems to scrape, harvest or place bulk orders without our consent.

10. Intellectual property in this website

The design, text, graphics and code of orcadigital.shop are owned by or licensed to ORCA DIGITAL PTY LTD. You may not copy or reproduce them without our written permission. This does not affect the rights of third parties in their own trademarks and product imagery.

11. Limitation of liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded.

Subject to that, and to the maximum extent permitted by law, our total liability arising out of or in connection with any product or these Terms is limited, at our option, to resupplying the product or refunding the price you paid for it.

We are not liable for loss caused by circumstances outside our reasonable control, including publisher-side outages, changes to publisher licensing terms, or account restrictions imposed by a publisher on you.

12. Governing law

These Terms are governed by the laws of the State of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that State.

If you are a consumer in another country, you may also have rights under the mandatory consumer laws of your own country, and nothing in these Terms limits those rights.

13. Changes to these Terms

We may update these Terms from time to time. The version published on this website at the time you place an order is the version that applies to that order.
